Despite the outcry in a section of the media against the demotion of Nuhu Ribadu, former Chairman of the EFCC and 139 others to their original ranks, a peep into their confidential files indicate that the exercise was in order

For the former Chairman of the
Economic and Financial
Crimes Commission (EFCC), Nuhu Ribadu, this obviously is not the best of times. Last week, what has since his unceremonious exit from the anti-graft agency remained in the realm of speculation finally berthed on the shores of reality: The possibility of his demotion from the rank of Assistant Inspector-General of Police (AIG).
Ribadu’s magical rise in the police force over and above his seniors within a space of two years was largely a function of former President Olusegun Obasanjo’s utter negation of the procedure for promotion in the force. The former EFCC boss who was given double promotions within two years, first from Deputy Commissioner of Police (DCP) to Commissioner and then from there to AIG, last week came under the scrutiny of the Police Service Commission (PSC), the body statutorily empowered to appoint promote and discipline all officers of the Police, except the Inspector General of Police (IGP).
In a release dated August 5, 2008, the commission frowned at the irregular promotion of 140 officers, Ribadu inclusive, prior to its inauguration without recourse to it. And so in righting the wrong, the PSC down-graded Ribadu from the rank of AIG to his last rank before the unorthodox rise. But the former financial crimes czar was not alone in the lowering of status. One hundred and thirty-nine others, including the late Kaduna State Commissioner of police, Haz Iwendi, also suffered the same fate.
The PSC rued that the promotion of Ribadu and the others was in total breach of section 153 of the 1999 constitution and the Police Service Commission Act, 2001– an action which according to the body, ruffled quite a lot of feathers in the force, engendering disillusionment, agitations and indiscipline as a result.
Thus, after consideration of President Umaru Yar’Adua’s avowed commitment to the rule of law and in order to guarantee a level-playing field for all members of the police force, according to the PSC, it decided to re-examine the guidelines for promotion ranging from Deputy-Inspector-General of Police to constable.
According to a handbook, “Guidelines for Promotion in the Nigeria Police”, prepared by the PSC, for an officer to attain the rank of AIG, he or she must attain the following criteria:
*Be of the rank of Commissioner of Police
*Be of unquestionable integrity, professionally knowledgeable, zealous and efficient in the discharge of his or her duties.
*Good Annual Performance Evaluation Report (APER) over a period of three years, with classification in categories A or B
*Have attended and passed the National War College Course or the National Institute for Policy and Strategic Studies (NIPSS) course or any other course commensurate with the said courses.
*Failure to pass the National War College or NIPSS would result in compulsory retirement.
*Must have consistently demonstrated high leadership quality, drive and commitment to or the ideals of effective and efficient democratic policing.
The candidate must also not have any pending disciplinary case or complaints/petitions of gross misconduct such as human rights violation, torture, extra-judicial execution or rape. A candidate who is cleared of any disciplinary charge may be considered for promotion which shall put him at par with other colleagues of the same seniority.
Other hurdles in the form of procedure for such candidate also include:
*Candidate completes an annual appraisal (APER) forms and submits it to Assistant Inspector-General of Police for endorsement.
*The Assistant Inspector-General of Police forwards the appraisal form to the National Appraisal Promotion Committee.
*National Appraisal Promotion Committee appraises and recommends to the Police Service Commission after evaluating the APER forms and self-appearance of the candidate before it.
*Police Service Commission conducts oral and/or written interview before approval of the promotion.
Ribadu and others who have now been returned to their original ranks, largely by-passed these procedures and criteria. In the case of Ribadu who is now on course at NIPPS he ejoyed waiver of the two cardinal criteria on his way to the AIG ladder. For example, he became an AIG at a time he was procedurally a DCP. Besides that, he neither attended NIPPS nor the National War College before Obasanjo decorated him with the status of an AIG.
The Source gathered that the intense disquiet in the police over the irregular promotions was so much that the dissatisfied officers who suffered the emotional and psychological torture of watching their mates and in some cases juniors – jump ranks and become their seniors overnight inundated the PSC with petitions and complaints.
The intensity of the petitions and their mind – boggling contents, police sources confided in The Source was to compel the PSC in May 2008 to request from the Force Secretary in Abuja, the files of the affected officers, that is officers who benefited from the unmerited promotions. Data obtained from the files, indeed, speaks volumes of the nepotism, favouritism and brazen disregard for service rules as regards promotions in the police force.
For example, information gleaned from Ribadu’s file showed that the former EFCC boss and one DCP Ibrahim Abdu were on the same seniority list. But while Abdu was only promoted CP on June 12, 2008 by the PSC, Ribadu who was on service number (S/No) 129 on the DCP staff list as at June 2006, became AIG the following year, precisely on April 9, 2007.
The anomaly becomes heart rending when viewed against the back drop of the fact that while Ribadu was on S/No 129, Abdu was on S/No 12 and became DCP long before Ribadu since January 22, 2002.
There is also the case of Chief Superinented of Police (CSP) said to be a relation of the immediate past Inspector-General of Police, Sunday Ehindero. The Officer, Sarah Idowu Ehindero's file show that she enlisted in the Police on June 10, 1994 and was on S/NO. 979 in the seniority list of Superintendents of police (SP) as at 26 June, 2006 when she was catapulted to the CSP rank.
According to information which The Source gleaned from her file, she did not have three years APER in SP rank as at the time she was illicitly promoted CSP. The murmuring in the force is that her undeserved rise was conditioned by the former IG’s influence, an action dubbed a wicked act of nepotism by sources within the force.
Naked farouritism, an enraged officer told The Source, also played out in the illegal promotions which certain officers who enjoyed the former IG’s confidence and those who closely worked with him had. A classical example is the case of CSP Ehiede Ohiozoba of the IGP’s secretariat, Force Headquarters, Abuja.
Ohiozoba was on S/No. 672 in the seniority list of SP as at June 26, when he was promoted CSP over and above his peers.
The same undeserving promotion was also accorded Sunday B. Olukoya. He was on S/No 369 in CSP seniority as a June 20, 2006 when he was elevated to Assistant Commissioner of Police (ACP), while CSP P.L. Garba on S/No.21 in the same seniority list has just been recommended to the PSC for promotion to the ACP rank.
The injustice which Garba suffered is also true of CSP Emeka Nwako-Osaji a medical Doctor. Nwako- Osaji, was on S/No 1 in the CSP medical staff list on May, 2001 and is yet to be promoted ACP, while Wilson O. Akhiwu, also a doctor at the Police Clinic, Falomo, Lagos who was on S/No 11 in CPS seniority medical list has since been promoted ACP.
Meanwhile, the PSC action has been generating varied interest. For example, the possibility of recalling Ribadu from his NIPSS course is looming. This is because, by virtue of his new status-DCP, he is not qualified to participate in the course as participation is open only to police officers from the rank of Commissioner and its equivalent in other services. But whose responsibility it is to order his recall is now a subject of controversy between the PSC and the inspector-General of Police, Mike Okiro.
While Okiro is insisting that in his words “the demotion was done by the PSC in the performance of its constitutional duty, and whatever is the aftermath of it should come from the commission,” the PSC maintains that it has completed its statutory duty and that it is now left for the IGP to take further steps in recalling Ribadu, since it was an IG, (Ehindero) who recommended Ribadu for the NIPSS course in the first instance.
Though the PSC action is being cheered within the police force, those outside it are not enamoured by the demotions.
Among such people are two Lagos lawyers, Gani Fawehinmi and Femi Falana. Fawehinmi alleged that the action against Ribadu was political – a sort of punishment for his arrest and trial of politicians as boss of the EFCC. Falana on his part argued that the PSC lacks constitutional powers to downgrade the police officers, including Ribadu.
Though Okiro was a DIG at a time the illegal bazaars were effected by Obasanjo and Ehindero, there are insinuations in some quarters that he himself is a beneficiary of an unmerited promotion. Critics who hold this view cite his sudden rise to the rank of DIG to buttress their claim. However this trend of reasoning, according to The Sources findings, is dwarfed by the fact that politics plays prominent role in who wears the DIG rank. Thus, Okiro became DIG by the time courtesy his geo-political zone’s (South south) right to produce one.
Though the PSC’s demotion blitz caught many of its victims unawares, the biggest fish in the whole drama, Ribadu, The Source can authoritatively reveal apparently saw it coming. And to avert the impending doom, he was said to have reached out to former Governor James Ibru of Delta State and other close associates of President Yar’Adua who he reasoned are behind his travails.
Ribadu, The Source gathered via his emisaries begged them to help ensure that his demotion, whenever it comes, should not go beyond the rank of commissioner of police in the event that the powers that be were still bent on the exercise.
A penitent Ribadu, The Source was told, told the men that as EFCC boss, he was merely carrying out Obasanjo’s orders and not that he had anything personal against them. Elated that Ribadu, a yesterday lion was now kow-towing to them in a sheep's garb, the Ibori group promised to help save him, but as soon as the emissaries from the anti-graft-fighter left, the men clinked glasses in celebration of the impending and inevitable fall of a man who just little over a year ago was their nightmare.
The president’s men, The Source gathered, had actually planned to get back at Ribadu in the form of releasing incriminating documents that could have seen him arrested and charged for corruption, had he resigned from the police, following his controversial removal from the EFCC and secondment to the NIPSS course.
